Terms and Conditions

Above Par Courier Service, Inc. (APC) provides prompt pick up and delivery of packages on an as needed or daily service schedule for our clients.  Upon setting up an account you agree to the terms set forth herein.  Above Par Courier Service is committed to making your experience as simple as sending a package from point “A” to point “B”.

I. Services

Courier Services

APC offers 4 levels of service.

• Standard Same Day   
  Ready by 10:30am for delivery by 5:30pm.
  Available Monday through Friday, excluding Holidays.

• Rush
  For delivery within 3-5 hours
  Available 24 hours a day 7 days a week.
  Additional charges will apply on weekends, holidays, and after hours.

• Super Rush
  For pick up and delivery as fast as possible with non stop driving to your destination.
  Available 24 hours a day 7 days a week.
  Additional charges will apply on weekends, holidays, and after hours.

• Overnight   
  Ready by 3:00 pm for delivery the following business day.
  Available Monday through Friday, excluding Holidays.

Service Of Process

All Service of Process if available Monday through Saturday, excluding Holidays.

• Standard        
  Service within 72 hours.                                 
  At least 2 attempts at the address provided will be performed within 72 hours

• Rush            
  Service within 36 hours.
  At least 2 attempts at the address provided will be performed within 36 hours
  Available Monday through Saturday, excluding Holidays

• Super Rush   
  Same Day Service
  At least 1 attempts at the address provided will be performed on the same day item received.

Floral and Gift Basket Services

• Economy Same Day     
  Ready by 10:30am for delivery by 5:30pm.                                    
  Available Monday through Sunday.
  Weekend and Holiday Deliveries subject to additional charge

• Rush             
  For delivery within 3-5 hours
  Available 24 hours a day 7 days a week.
  Additional charges will apply on weekends, holidays, and after hours.

Photo Services

• Economy
  Order placed by 10:30am; Photo’s received by 7:00pm the same day
  Order placed after 10:30am; Photo’s received by 7:00pm the next business day                   
  Available Monday through Friday, excluding Holidays.

• Rush              
  For Service within 3-5 hours
  Available 24 hours a day 7 days a week.
  Additional charges will apply on weekends, holidays, and after hours.

II. Service Area

The primary service area of APC is South Florida (Dade, Broward, Palm Beach).  APC is able to provide affordable delivery services nationwide with the use of our business partners.  APC is an registered Indirect Air Carrier and is able to offer next flight out service Nationwide. Additional Charges may apply for some services outside of the primary service area.   Certain service options are not available to all parts of South Florida and other areas.

III. Packaging

Shipments tendered to APC for transportation will be contained in securely fastened and properly addressed packages, container or mail bags conforming to applicable United States Post Office rules and regulations, and regulations applicable to private express shipments. Package shall not contain contraband or other illegal materials. All computer tapes, disks, and other items subject to, magnetic or electronic damage, will be contained in suitable protective packaging clearly marked with an appropriate warning. 

APC accepts certain classes and divisions of hazardous materials for transport. Before you ship, please contact APC to ensure your packages contain accepted hazardous materials. APC will handle these materials only when packaged in special permit packaging or when packaged in accordance with DOT exception 49 CFR 173.13, which does not require DOT diamond-shaped hazard labels.

APC does not restrict the size and weight of packages, but reserves the right to refuse a delivery if a specialty vehicle (van, truck, refrigerated truck, etc) is unavailable, or an alternate time/date can not be agreed upon.                                                        
                                                               
IV. Pricing

Courier pricing is address to address specific.  Price guides for a specific address are available by calling APC (954-915-8727).  For a quote on a specific job, call APC or enter the job details on line at www.apcourier.com. Service of Process, Floral and Gift Basket Service, Photo Services are area specific.  Price guides may be obtained by calling APC (954) 915-8727. Customers are responsible to know the actual charge for service performed, prior to the service being performed.   Prices quotes are based on information provided by customer and may change when actual service is performed, which may have an impact on the charges. 

Additional charges may apply for the following; multiple items to the same address, shipments over 25lbs, shipments requiring a special vehicle such as a van or box truck, the need for an additional person, rerouting to alternate address or incorrect address,  waiting time, and fuel surcharge.

IV. Waiting Time

Waiting charges for courier services, floral and gift baskets services, and photo services are assessed at $6.00 per 10 minutes.   Service of Process waiting time is assessed at $10.00 per 10 minute increments.  Charges are assessed after the first 10 minutes and are rounded up to the next 10 minute increment.

V. Fuel Surcharge

APC reserve the right to assess fuel and other surcharges on shipments and process service without notice. The duration and amount of any surcharge will be determined at our sole discretion. By tendering your shipment to APC, you agree to pay the surcharges, as determined by APC. The fuel surcharge. rate, if applicable, is available by calling APC or at www.apcourier.com

VI. Legal Support Services

Our experienced staff has developed the necessary retrieval and research skills in order to handle any court related search. We are consistently minutes away from the courthouses in Dade, Broward, and Palm Beach County and could retrieve your legal documents within hours. APC can assist your firm with the simplest court filings to searching extensive and complex files.

APC performs skip trace service including: locating the current address for service of process, conduct real property searches, vehicle tag verification, corporate searches and much more.

VII. Payments

Customers may pay by credit card, check or cash.  Customers may set an auto payment as invoices become due.  We would prefer clients who choose to be invoiced every other week to have a credit card on file.  Invoices not paid within 30 days are subject to a $5.00 service charge and the credit card on file will be automatically charged.  If you would like to make alternative invoicing arrangements, please call 954-915-8727, ext 303.

VIII. Loss Limitations

Above Par Courier Service, Inc. use care in handling your documents and packages.  However, in consideration of the rate charged both parties agree that the value of any one stop is not more than $60 (regardless of the number of packages).  This limit is also the maximum liability of APC in the event of damage or loss, regardless of cause.  APC shall not be accountable for any damage or loss caused by delay, or improperly packed or labeled shipments. Additional insurance coverage may be obtained prior to pick up.  Claims regarding loss or damage of any kind must be made in writing within 30 days of the pick up date.  Claims not made in writing within 30 days shall be considered waived by the Client.  Client agrees that APC is held harmless against any claim of a 3rd party for the loss or damage of any package delivered by APC.  Additional insurance coverage may be obtained prior to pick up.

APC SHALL NOT BE LIABLE IN ANY CASE FOR DELAY IN DELIVERY OR FOR INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, WHETHER OR NOT APC KNEW, OR SHOULD HAVE KNOWN, THAT SUCH DAMAGES MIGHT BE INCURRED, INCLUDING, BUT NOT LIMITED TO, LOSS OF INCOME, LOSS OF PRODUCTION, INCREASE IN EXPENSE, INTEREST, PROFITS, BUSINESS OPPORTUNITY, BANK COLLECTIONS OR SIMILAR FEES.

IX. Disputes

In the unlikely event a dispute arises between the Customer and APC and it can not be resolved between the parties. The Terms and Conditions contained herein shall be interpreted and construed according to, and governed by, the laws of Florida, excluding any such laws that might direct the application of the laws of another jurisdiction. The federal or state courts located in Broward County, Florida shall have jurisdiction to hear any dispute. In the event of any litigation arising from or related these Terms and Conditions,  or the services provided, the prevailing party shall be entitled to recover from the non-prevailing party all reasonable costs incurred including staff time, court costs, attorneys fees, and all other related expenses incurred in such litigation. In the event of a no-adjudicative settlement of litigation between the parties or a resolution of a dispute by arbitration, the term “prevailing party” shall be determined by that process.

X. Amendments to Terms and Conditions
